This Health & Wellness Data Consent explains how Evergreen Venture Partners Co., Ltd, trading as Evzino ("Evzino", "we", "us" or "our"), uses health and wellness information to provide and personalize Evzino and Evo.

Please read this Consent together with our Privacy Policy. Where applicable law requires consent for health or other sensitive information, this Consent is separate from your acceptance of the Evzino Terms & Conditions.

1. Why we are asking for your consent

Evzino is designed to learn from information you provide and from your use of the service so that Evo can give you increasingly personalized nutrition, fitness, wellness and lifestyle support.

Some information used for this purpose may be considered health data, consumer health data, sensitive personal information, special category data or similarly protected information under applicable privacy laws.

Where applicable law requires consent for this processing, we ask for it separately. Your acceptance of the Evzino Terms & Conditions does not replace this consent.

2. Health and wellness information covered by this consent

Depending on the features you choose to use, this consent may cover the following information.

Goals and starting information

• wellness, nutrition or fitness goals;

• current weight and goal weight;

• height;

• date of birth and age;

• sex used for physiological calculations;

• activity level and fitness status;

• dietary pattern and nutrition preferences;

• relevant lifestyle, schedule and routine information.

Nutrition information

• meals and foods you log;

• meal photographs and meal descriptions;

• estimated portion sizes, calories and macronutrients;

• drinks and hydration;

• dietary restrictions and foods you choose to avoid;

• food allergies and medically relevant food restrictions where you provide them;

• meal timing and eating patterns.

Fitness and movement information

• workouts and exercise type;

• exercise frequency and timing;

• movement and activity;

• training environment and equipment information;

• fitness preferences, goals and progress.

Wellness and behavioral information

• habits and routines;

• barriers or constraints you tell us about;

• consistency patterns;

• responses to reminders or recommendations;

• progress information;

• relevant information you choose to share with Evo through WhatsApp, the Evzino application or another Evzino service.

AI-derived information

Evzino may derive information from the information above. This may include observations, patterns, personalized profile attributes, estimates, behavioral features, hypotheses, predictions about what support may be useful, likely preferences, recommendations, and information about which Evzino interventions appear to work better or worse for you.

These are not necessarily facts. Evo may be wrong, and Evzino is designed to allow important information and interpretations to be corrected or updated.

3. What we use this information for

Providing the Evzino service

• create and maintain your personalized profile;

• calculate starting wellness, nutrition and fitness estimates;

• provide meal, nutrition, activity and workout logging;

• analyze meals or activities you submit;

• generate Evo Briefs and progress summaries;

• keep track of information you ask Evo to remember;

• provide reminders and related functionality;

• provide features included in your Evzino plan.

Personalizing Evo

• understand your stated goals and preferences;

• learn from your behavior over time;

• distinguish what you tell us from what the system observes or infers;

• identify patterns relevant to your goals;

• tailor the timing, format and content of guidance;

• decide when an intervention or reminder may be useful, or when it may be better not to interrupt you;

• recommend appropriate next steps;

• adjust recommendations when new information becomes available.

Improving your personal experience

We may learn which recommendations, reminders and interventions appear useful for you and use that information to improve future support provided to you.

Safety and reliability

• take account of relevant restrictions or allergies you provide;

• identify potentially inappropriate recommendations;

• correct inaccurate information;

• investigate errors;

• maintain appropriate safety controls.

4. AI personalization

Evo is an artificial intelligence system. Evzino may use AI and statistical systems to interpret your information and generate personalized observations, estimates, recommendations and predictions.

The system may distinguish among facts known to Evzino, information you expressly declare, behavior observed by the service, AI-generated inferences, hypotheses, confirmed patterns and recommendations.

An AI-generated inference does not become a medical fact merely because Evo generated it. You can correct information that appears inaccurate. Where required by applicable law, you may also have rights to object to, restrict, access or request review of certain processing.

5. What this consent does not authorize

This consent does not, by itself, authorize Evzino to:

• sell your health or wellness information;

• disclose your detailed health or wellness profile to advertising platforms for targeted advertising;

• upload detailed health, nutrition, allergy, physiological or AI-derived health information to advertising platforms for ad optimization;

• provide medical diagnosis or treatment;

• use your information for a materially different purpose where applicable law requires separate consent.

If Evzino later wants to use protected health or wellness information for a materially different purpose requiring additional consent, we will ask you separately before doing so.

6. Service providers and people who may process this information

To provide Evzino, your information may be processed by carefully selected providers acting for or supporting Evzino, including providers of hosting and cloud infrastructure, database and storage services, AI technology, image or meal-analysis technology, security and monitoring, authentication, customer support, communications and messaging infrastructure.

If you purchase a plan that includes human support, relevant information may also be made available to authorized Evzino advisors or coaches where reasonably necessary to provide that service. Access should be limited to information reasonably necessary for the person's role.

Our Privacy Policy describes these categories in greater detail. Where applicable law requires separate consent before a particular disclosure or sharing of health information, Evzino will obtain that consent before the disclosure.

7. Advertising

Evzino may use ordinary advertising and acquisition information, such as campaign identifiers, referral sources or landing-page interactions, to understand how users discover Evzino.

Evzino does not use this Consent as authorization to provide detailed health/wellness profile information or AI-derived health insights to advertising platforms for advertising optimization or targeting.

8. Product improvement and broader AI learning

Information about your use of Evzino may be used to operate, secure, debug and improve the service as described in the Privacy Policy.

Where possible and appropriate, broader analytics and product learning should use aggregated or de-identified information. This Consent does not automatically authorize unrestricted use of identifiable sensitive health information to train general-purpose AI models unrelated to providing or personalizing your Evzino service.

If a separate consent is legally required for a materially different model-training purpose, Evzino will request it separately.

9. How long the information is kept

Evzino retains information only for as long as reasonably necessary for the purposes described in this Consent and the Privacy Policy, subject to account status, the type and sensitivity of the information, applicable legal obligations, security and fraud-prevention needs, disputes or legal claims, and valid deletion requests.

10. Your choice

Your consent is voluntary. If you choose not to provide this consent, Evzino may be unable to provide features that require health and wellness information or personalized health/wellness processing. Where technically and commercially available, features that do not require such processing may remain available.

11. Withdrawing your consent

You may withdraw this consent at any time by using privacy or account controls provided by Evzino, where available, or by contacting [PRIVACY EMAIL].

Withdrawal does not affect the lawfulness of processing that occurred before withdrawal. After withdrawal, Evzino will stop processing the relevant information on the basis of this consent for future purposes, subject to processing that remains permitted or required by applicable law. Some personalized features may stop working after you withdraw consent.

You may also request deletion of applicable information as described in our Privacy Policy.

12. Your privacy rights

Depending on where you live, you may have rights to know whether Evzino processes your information, access information about you, obtain a copy of it, correct inaccurate information, request deletion, withdraw consent, object to or restrict certain processing, obtain portable information, appeal certain privacy decisions, and complain to a privacy or data-protection authority.
